Scope of the General Terms and Conditions
“Visualista GmbH (hereinafter Visualista.ch) provides its services exclusively on the basis of the following General Terms and Conditions (GTC).”
Prices
The price listed in the price list, or individually agreed upon, includes all of the specified services. Additional services will be arranged and billed on an individual basis. Visualista.ch reserves the right to adjust the package prices and the services included therein at any time. All prices are quoted in CHF and are exclusive of VAT.
pay
The invoice is to be paid without deductions within 30 days from the invoice date.
After the payment deadline, a default interest of 5% becomes due. Additionally, an administration fee of CHF 50 will be charged for each reminder. Visualista.ch reserves the right to assign outstanding claims to a collection agency or to commission a collection agency to recover the debt. Corresponding additional costs incurred will be passed on to the customer. For larger orders, Visualista.ch reserves the right to require a down payment/advance payment and/or to conduct a credit check.
Cancellation / postponements
Cancellations of an order are free of charge up to 7 days before the appointment. Cancellations made later will be handled as follows:
- From 7 to 3 days prior to the scheduled appointment: 50% of the total sum.

Copyright, data backup, and usage rights
The customer accepts that the necessary personal data for processing the order will be stored on data carriers. Upon final booking, they consent to the collection, processing, and use of their personal data. The customer is entitled, at any time, to request deletion of the data as well as revocation of consent, provided that the agreed-upon services have been completed.
The agreed products will be provided to the customer in electronic form. The customer is solely responsible for ensuring the data is backed up in compliance with data protection regulations. After 6 (six) months, Visualista.ch reserves the right to delete all data, unless the contract stipulates that they be kept online/stored for a longer period.
Visualista.ch is considered the author of the recorded images. These images are protected by copyright. The customer is granted the right to publish the images. The transfer of this usage right requires the consent of Visualista.ch. Visualista.ch may require that it be credited as the author of the images. In such a case, the notation “©Visualista.ch” must be placed beneath the photos.
Visualista.ch may use any content created for promotional purposes.
Liability
Visualista.ch is liable only for direct damages that it has caused either through gross negligence or intentionally. The maximum amount of damages is limited to the sum agreed upon for the assignment.
In addition, Visualista.ch assumes no liability for lost profits, consequential damages, or damages arising from business interruptions.
Final provisions
If any provisions of these general terms and conditions become invalid, all other contractual provisions remain valid.
Jurisdiction
In principle, Swiss law applies. The court located in Zurich is the competent jurisdiction for claims. If the customer resides abroad, Zurich is also designated as the place of jurisdiction.
