Bird’s-eye views are now the gold standard in real estate marketing. But especially in densely populated Swiss residential areas, trouble is often lurking just a few metres above the ground. A buzzing sound on a Saturday morning, a suspicious glance at the sky—and the neighbourhood conflict has arrived. Worse still: without proper planning, hefty fines from FOCA or civil lawsuits may follow.

As a real estate professional, you want impressive images that sell—and not letters from a lawyer. This article is your compliance guide. We explain where the legal boundaries lie and how, with a professional partner like Visualista, you can produce breathtaking footage without crashing legally.

The New Airspace: FOCA Regulation and the “Open Category”

Since 1 January 2023, the legal situation in Switzerland has changed fundamentally. With the adoption of the EU drone regulation, stricter rules now apply—rules that many “hobby pilots” still ignore, creating a risk that can fall back directly on you as the client.

Today, what matters most is no longer just the camera, but the weight. At Visualista, we consistently rely on state-of-the-art technology in subcategory A1. For this we use specialised drone models such as the DJI Mini Pro series. These devices weigh under 250 grams and therefore fall into the most liberal category of the drone regulation.

Expertise Instead of Blind Flight Manoeuvres

Our photographers receive specialised in-house training and all have the necessary drone certifications. Even though using ultralight A1 drones exempts us from many complex restrictions, safety remains the top priority. Our pilots know the local zones and applicable rules in detail. Before every take-off, a professional pilot checks the situation for up-to-date no-fly zones to rule out conflicts with restricted areas or local heliports from the outset.

Mein Haus, mein Luftraum? Das Zivilrecht und der HEV

“Over my property, I decide!”—that’s the common view of many owners. But how far does ownership really extend into the sky? Under Art. 667 para. 1 of the Swiss Civil Code (ZGB), ownership extends upward only as far as there is a “legitimate interest worthy of protection.”

Courts and the Swiss Homeowners’ Association (HEV) have clarified this in practice. An overflight at a great height is usually unproblematic. It becomes critical in low-altitude airspace, which is considered a private retreat. A careless low flight over the neighbour’s garden can quickly be viewed as an invasion of privacy. Visualista strictly ensures that neighbouring properties are captured only as neutral background and that the sales object is clearly the focus.

Privacy and Data Protection: The Red Line with Neighbours

The Federal Act on Data Protection (FADP/DSG) is unambiguous here. As soon as people are identifiable, recording without consent is not permitted. Car licence plates or looking into a neighbour’s apartment are also taboo.

If a neighbour explicitly requests that their property not appear in the footage, we implement this technically. In post-production, we can obscure or pixelate buildings or sensitive areas. Interestingly, in such cases we often point out that the properties are publicly visible anyway via services such as Google Maps—yet for neighbourhood peace and the realtor’s legal certainty, our professional retouching is the safer route.

“When a realtor hires a professional photographer, they can outsource a large part of the legal risk. We know the rules, are registered, and know exactly what is allowed and what is not.”

Minimising Liability Risks for Realtors

Many realtors don’t know that anyone operating a drone with a camera must be registered. This registration number must be physically affixed to the drone—e.g., with a sticker or permanent marker. If this identification is missing during a police inspection, problems can arise immediately.

By hiring a professional, you outsource this risk. Visualista consistently refuses assignments that would violate applicable law (e.g., flights in absolute no-fly zones despite a realtor’s request). Because we work exclusively with 10 full-time employed photographers, every flight is covered by comprehensive commercial liability insurance.

Best Practice: How Visualista Plans Safe Flights in Residential Areas

To avoid escalation, we have established a proven process:

  1. Timing of the flight: We generally carry out drone shots at the end of an appointment. If the on-site situation—such as an upset neighbour—becomes difficult, we can stop the flight at any time and leave without jeopardising the rest of the shoot.
  2. On-site transparency: If neighbours have questions during the flight, our pilots land the drone immediately. We calmly explain why we are taking the shots. Often, offering to show the neighbour the images directly on the monitor helps dispel suspicions of spying.
  3. Noise protection: The mini models we use are extremely quiet. Many realtors are surprised at how unobtrusively these devices operate compared with large industrial drones.
  4. Efficiency: Thanks to cutting-edge technology, we only need a few minutes on site for perfect image material.

This diligence naturally also applies to our real estate videos, where we protect the privacy of the surrounding area through smart flight paths.

Frequently Asked Questions (FAQ) About Drones in Residential Areas

Do I have to ask neighbours for permission before I fly?

Legally, this is often not mandatory for flights at an appropriate height, but we recommend it as a matter of courtesy. A short conversation takes the wind out of the sails of potential critics.

What penalty applies for violating FOCA rules?

The fines are significant and can be up to CHF 20,000. In addition, illegal flights risk voiding insurance coverage.

What happens if a neighbour wants to stop the flight?

We seek a conversation. In most cases, the situation can be resolved through clarification. If a neighbour still insists that their house be pixelated, we do this professionally in post-production.

Conclusion – Safety Through Professionalism

Drone footage is now indispensable for presenting a property emotionally. Whether it’s worth using depends on the property—but the risk of an unprofessional flight is never worth it.

Choose a partner who takes responsibility. Visualista not only delivers spectacular images, but also guarantees a legally compliant process without unpleasant surprises.
